"customer" = the user of the service

Subject to the payment of the purchase price, the customer shall be entitled to use the service and for the purposes of supporting the permitted use, the customer may reproduce, print, and/or make back-up copies on any computer system

other use

Save for the permitted use, the customer will not sell any part of the service to third parties nor may the customer distribute materials to third parties for sale or resale whether as part of a package or as a separate product. The customer will not rent, lease, sub-licence, loan, copy, modify, adapt, merge, translate, disassemble, or create derivative works based on the whole or any part of the service (except as expressly provided in this licence or permitted by the copyright [Computer Programs Regulations 1992] )

ownership

www.desktopalerting.com shall at all times retain ownership of the service

service

www.desktopalerting.com undertakes that it will take all reasonable steps to correct any defects in the service in a timely manner. However, www.desktopalerting.com will not be liable for any loss of any kind including lost profits or other consequential losses arising from the customer's use or inability to use the service or from errors or deficiencies in any part of it whether caused by negligence or otherwise except as expressly provided herein. The parties hereby agree that the expressed terms in this licence are in lieu of all warranties, conditions, undertakings, terms, and obligations implied by statute, common law or otherwise all of which are hereby excluded to the fullest extent permitted by law.

English law shall govern this agreement.
